Welcome to DC Pool Supply (the “Site”), operated by DC Pool & Spa Supply (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) and Privacy Policy (“Privacy Policy”) govern your access to and use of the Site, including any content, functionality, and services offered on or through the Site. By accessing or using the Site, you agree to be bound by these Terms and Privacy Policy. If you do not agree, you must not use the Site.

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which may harm us or users of the Site.

• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.

3. Orders, Payments, and Pricing

• Orders: All product descriptions, images, and prices are for illustrative purposes only and may not be entirely accurate. We reserve the right to correct errors or discontinue products without notice. We may refuse or cancel orders at our discretion, including due to pricing errors, unavailability, or suspected fraud.
• Payments: You agree to pay all fees and charges for purchases made through the Site. We accept major credit cards and other payment methods listed at checkout. All payments are processed securely, but we are not liable for unauthorized charges due to your negligence.
• Pricing and Taxes: Prices are in USD and exclude taxes, shipping, and handling fees, which will be added at checkout. We may change prices at any time without notice.

4. Shipping and Delivery

Products will be shipped to the address provided at checkout. Shipping times are estimates only; delays may occur due to carrier issues, weather, or other factors beyond our control. Risk of loss passes to you upon delivery to the carrier. We are not responsible for shipping delays or lost/damaged packages once handed to the carrier—file claims directly with them.

5. Returns and Refunds

We aim for your satisfaction. Returns are accepted within 30 days of delivery for unused, unopened products in original packaging. Defective or incorrect items may be returned within 14 days for exchange or refund. Contact us at (916) 234-6499 or via the Site’s contact form for return instructions. Shipping costs are non-refundable unless the return is due to our error. Refunds will be issued to the original payment method within 7-10 business days of receiving the return.

6. Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to text, graphics, logos, images, and software) are owned by us or our licensors and protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

The Site and products are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. 10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Sacramento County, California. You waive any objection to venue or inconvenience of forum.

12. Miscellaneous
